General Terms and Conditions

ARTICLE 1 - DEFINITIONS

In these terms and conditions the following terms shall have the following meanings:

  • Entrepreneur: Aneya Luxury, the legal entity that offers products remotely to consumers.
  • Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
  • Distance contract: an agreement concluded between the trader and the consumer within the framework of a system organised by the trader for the distance sale of products, whereby up to and including the conclusion of the agreement exclusive use is made of one or more techniques for distance communication.

ARTICLE 3 - APPLICABILITY

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

ARTICLE 4 - THE OFFER

If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer. The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.

ARTICLE 5 - THE AGREEMENT

Subject to the provisions of paragraph 4, the agreement is concluded at the moment the consumer accepts the offer and meets the conditions set therein.

ARTICLE 6 - RIGHT OF WITHDRAWAL

When purchasing products, consumers have the right to cancel the agreement without giving reasons within 14 days. This cooling-off period begins on the day after the consumer receives the product.

ARTICLE 7 - EXCLUSION OF RIGHT OF WITHDRAWAL

For hygiene reasons and to protect public health, jewelry whose seal or packaging has been broken after receipt by the consumer or that has clearly been worn is excluded from the right of withdrawal . This includes (but is not limited to) earrings, necklaces, rings, and other products that come into contact with the skin or body and where the original packaging or seal has been broken.

Personalised jewellery (e.g. engraved or custom-made jewellery) is also excluded from the right of withdrawal.

ARTICLE 7 - COSTS IN THE EVENT OF WITHDRAWAL

If the consumer exercises his right of withdrawal, the costs of return will be at his expense.

ARTICLE 8 - THE PRICE

During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates. The prices stated in the product offer include VAT.

ARTICLE 9 - DELIVERY AND EXECUTION

The entrepreneur will exercise the utmost care when receiving and fulfilling orders for products. The delivery address is the address the consumer has provided to the company.

ARTICLE 10 - PAYMENT

Unless otherwise agreed, amounts owed by the consumer must be paid within 14 days after the start of the cooling-off period as referred to in Article 6 paragraph 1.

ARTICLE 11 - COMPLAINTS PROCEDURE

Complaints regarding the performance of the agreement must be submitted to the entrepreneur within a reasonable time, fully and clearly described, after the consumer has discovered the defects. Submitted complaints will be answered within 14 days from the date of receipt.

ARTICLE 12 - DISPUTES

Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
